Buyer and Seller agree to the following conditions of sale:
This is a binding contract to protect the seller, buyer, and puppy.
All puppies require a $1,000 deposit. Once a deposit is received from buyer, said puppy will belong to buyer. If buyer decides to not get said puppy for any reason, the deposit will be forfeited. If the deposit of for “open deposit” (meaning no puppy was chosen), then buyer can wait until seller has an available puppy that buyer likes.
The seller guarantees that the puppy is in good health and has received vaccines and care appropriate to the age of the puppy. The fact that the puppy has been immunized does not guarantee immunity. It MUST have a series of vaccinations, with the final booster given between 4 and 5 months. Buyer will avoid going into public places until all vaccines have been given. Seller will provide buyer with a health record detailing treatment the puppy has received under the seller’s care. Seller also provides a 1 year health guarantee against any debilitating congenital defects.
1. Buyer must take the puppy to their Veterinarian within 72 hours of receiving the puppy and email a copy of the dated receipt or Veterinarian notes to the seller at laura.delorey12@gmail.com for the 1 year health guarantee to be in effect. Injury beyond seller's control is not guaranteed. Every effort is made to ensure the puppy's health and well-being. Seller is not responsible for environmentally induced and/or easily treatable disorders or conditions such as, but not limited to, kennel cough, pneumonia, hypoglycemia, coccidiosis, allergies, giardia, parasites, mites, other autoimmune disorders, cherry eye and entropion that are not covered in the guarantee. These conditions are all treatable and do not warrant an exchange in the puppy. Every preventative effort has been made by seller (deworming's, and vaccinations) to guard against these types of problems. Under New Hampshire state law you have the right to inspect the official health certificate containing a description and medical history of any dog offered for transfer and to have a copy of such certificate for any animal you may obtain.
Under New Hampshire state law, within 14 days of transfer, you may have the dog examined by a licensed veterinarian of your choice. Unless such exam indicates the animal is free of disease, you may obtain a substitution of a similar animal of equal value or, at your option, a full refund of any money exchanged at transfer but only if within 2 business days of such examination you return the diseased animal to the store/breeder along with a written statement from the veterinarian that the animal was not free from disease. N.H. Code Admin. R. Agr 1704.07
2. Buyer agrees to notify the seller of any significant health problems encountered that might be of a genetic/hereditary origin.
3. Buyer's purpose for purchasing above puppy is for Pet.
For Pets: The seller recommends that the buyer wait until 18-24 months to have the puppy spayed/neutered. The buyer does not have the right to breed said puppy. If the purchased puppy is used to produce a litter, the breeder will be entitled to be compensated for breach of contract. The Buyer then agrees to pay the breeder an additional $2000 above the purchase price of the original puppy and the current New England market value of French Bulldog puppies for each puppy produced. The general health guarantees as well as the genetic guarantee becomes void if the spay/neuter contract is violated. This is meant to protect our reputation and bloodlines.
For Breeding: Seller will provide puppy registration paperwork for the kennel club. Puppy must be registered with prefix “Remarkabulls” then name of said puppy. Buyer must register puppy prior to breeding. Buyer agrees, they will ONLY breed said puppy to another registered French Bulldog. If the purchased puppy is used to produce a litter with a non-registered French Bulldog, or any other dog breed, the Seller will be entitled to compensation for breach of contract. The Buyer then agrees to pay the Seller an additional $2000 above the purchase price of the original puppy and the current New England market value of French Bulldog puppies for each puppy produced. The seller can not guarantee that said puppy will natural breed, be fertile, deliver puppies, or be of breeding quality. The seller recommends that the buyer wait to breed the female after her 3rd heat cycle and/or 24 months old. For males, the seller recommends waiting until after 12 months of age.
4. The buyer agrees that they will not surrender the puppy to an animal shelter or rescue. If the buyer should ever find themselves in a situation where the puppy cannot be kept, and a suitable, loving home cannot be found, the seller asks that the buyer contact them for help. If necessary, the seller will gladly provide a loving home for the puppy until they can be placed in a new home. No refund will be provided by seller.
5. The buyer agrees that the puppy is not to be left solely in a backyard or kennel and will be allowed to spend substantial quality time in the home with family members. The puppy is sold with the understanding that it was to go to carefully selected parties, and the buyer agrees that the puppy shall become a member of the family.
6. The buyer agrees to maintain preventative care of the puppy such as proper nutrition using a high-quality dog food, proper age-appropriate exercise, and keeping the puppy at a healthy body condition score for the entirety of the dog’s life.
7. The buyer agrees to maintain preventative health care of the puppy including, but not limited to: vaccines, and parasite prevention as recommended by their veterinarian.
8. Buyer acknowledges that there is NO guarantee on puppy’s final coat, weight, color, texture or amount of shedding.
9. Seller recommends that the Buyer gets the puppy professional training and be covered under pet insurance. This agreement is made and signed by both parties to ensure the wellbeing and protection of this puppy. Should the seller need to seek legal action against the buyer for violations of this agreement, the buyer will assume all attorney costs and court fees
10. Puppies being held should be picked up by purchaser at 8 weeks of age. In case of delay of pickup, breeder is not liable for next scheduled vaccination and vet visit.
11. Buyer understands they are purchasing a puppy who will need to be house trained and learn basic manners. This is a process and could take up to a year or longer.
